If your AI agent is generating privacy policies, user-facing disclosures, or anything that touches personal data, there's a good chance it's violating GDPR. Not because you're careless—but because LLMs don't know the law. They pattern-match, and GDPR requires precision.

1. Third-party recipients not specifically named

The violation: GDPR Article 13.1(e) requires you to name specific third parties who will receive user data. Your AI probably writes something like:

"We may share your data with trusted partners to improve our services."

Why it fails: "Trusted partners" is not a name. GDPR demands specificity. You need to say "Stripe, Intercom, and Datadog"—not "partners."

The fix: If your AI is generating privacy disclosures, pass it a list of actual third-party service providers. Better yet, check the output against GDPR Article 13 before it ships.


2. Data retention period not specified

The violation: GDPR Article 13.2(a) requires you to state how long you keep personal data. AI-generated policies often say:

"We retain your data as long as necessary."

Why it fails: "As long as necessary" is not a period. You need to say "30 days after account deletion" or "24 months from last login."

The fix: Either hardcode retention periods in your prompt, or validate the output to ensure a time period is present.


3. Missing opt-out rights for California residents

The violation: CCPA § 1798.100 gives California residents the right to opt out of data sharing. If your AI generates terms that mention data sharing but don't mention opt-out, you're non-compliant.

Example:

"We may share your information with analytics providers."

The fix: Add: "California residents may opt out of data sharing at any time via our privacy settings."


4. Vague consent language

The violation: GDPR Article 7 requires consent to be "freely given, specific, informed, and unambiguous." Your AI might generate:

"By using our service, you agree to our data practices."

Why it fails: Implied consent (via "by using") is not valid under GDPR. Consent must be an affirmative action.

The fix: Use explicit opt-in checkboxes. Never bundle consent into terms acceptance.


5. No AI disclosure when required

The violation: The EU AI Act (Article 52) requires disclosure when users are interacting with an AI system. If your chatbot, content generator, or automated decision tool doesn't say "this is AI-generated," you're in violation.

Example: A customer support bot that never identifies itself as automated.
